Ventura County Pregnancy/Disability Lawyer

Oxnard FMLA and ADA Rights Attorney

Employees with disabilities should be welcomed into the workplace. Further, pregnant women in California have a number of rights under both state and federal laws. In many cases, employers discriminate against disabled employees. This discrimination is illegal under a host of state and federal laws. Further, many women are not fired, demoted or are otherwise disadvantaged for taking leave to care for their newborn children.

Both disability discrimination and pregnancy discrimination are illegal. If you have been discriminated against on either of these grounds, it is important to work with an experienced lawyer. The Law Office of Nicolas C. Vrataric will uphold your rights under state and federal laws.

Pregnancy Discrimination

Pregnant women have rights under state and federal law. Under the federal Family and Medical Leave Act (FMLA) and the California Family Rights Act (CFRA), pregnant women can take up to 12 weeks of unpaid leave to care for their children. If there are complications in the pregnancy, of if a mother is suffering from a condition related to her pregnancy, she can take up to 16 additional weeks of unpaid leave under California's Pregnancy Disability Leave Law (PDLL). When you return from leave in these situations, your employer is required to return you to your previous position — or a comparable position. If your employer has terminated you while you were on leave, or has discouraged from exercising these rights, our law firm will take action against your employer.

Disability Discrimination

Individuals with disabilities have a number of rights under both California's Fair Employment and Housing Act (FEHA) and the federal Americans with Disabilities Act (ADA). FEHA bars employers who are staffed with five or more employees from discriminating against people on the basis of physical or mental disability. If you are disabled and are able to perform the essential functions of a job, your employer must make reasonable accommodations to allow you to perform these tasks. When employers discriminate against disabled individuals, or refuse to make reasonable accommodations, our law firm can protect your rights.
